ELIGIBILITY: The Tractor Swag Giveaway (the “Promotion”) is open to legal US residents who are 18 years of age or older. If a minor, the entrant’s parent or legal guardian must read and agree to these Official Rules. Any determination of eligibility will be made by the Sponsor whose decisions are final and may be made at any time. The Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited/restricted by law or organizational policy. The Promotion is a trade promotion and not open to the general public.
HOW TO ENTER: Scan the QR code between 10 AM and 6 PM Eastern Standard Time (“EST”) on Saturday, September 21, 2024 at our event at the Saratoga Performing Arts Center (108 Avenue of the Pines, Saratoga Springs, NY 12866) or at our cocktail event between 7:30-9 PM EST on September 25, 2025 at 315 west 35th street New York, NY 10001 and subscribe to Sponsor’s email list. Doing so will earn you one entry into the Promotion. Limit one entry per person.
DRAWING/PRIZES/ODDS OF WINNING: On or about October 5, 2024, three random drawings will be conducted by Sponsor from among all eligible entries received. Winners will win a pack of our canned beverages, a Tractor Beverage hat, t-shirt, and stickers. The maximum approximate retail value (“ARV”) of each prize is $45. Winners will be notified by email. Odds of winning will be determined by the number of eligible entries received.
AGREEMENT TO OFFICIAL RULES: Participation in the Promotion constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules (the “Official Rules”); and the decisions of Sponsor and its designees (including but not limited to such parties’ interpretations of these Official Rules) which are final and binding. Winning a prize is contingent upon meeting all requirements set forth herein. Any entrant may be disqualified at Sponsor’s sole discretion if they fail to comply with any of the terms of these Official Rules.
GENERAL: Taxes on each prize and expenses related to acceptance and use of prize are the sole responsibility of the respective winners. By participating, entrants agree: (a) to these rules and decisions of the Sponsor which shall be final in all respects; (b) to forever and irrevocably release, discharge and hold harmless Sponsor, Sponsor’s advertising and promotion agencies, and each of their respective parents, subsidiaries, affiliates, and dealers, together with the respective officers, directors, employees, representatives, agents, shareholders, successors and assigns of each (aforementioned individuals and organizations collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use/misuse of any prize; and (c) that the Released Parties have not made any representation, warranty or guaranty, in whole or in part, in law or in fact, relative to any prize awarded. Winner (and winner’s parent/legal guardian if winner is a minor in their jurisdiction of residence) may be required to complete a Declaration of Eligibility and Liability Release and (where legal) a Publicity Release, which must be returned within the time period specified by Sponsor or an alternate winner may be selected. Released Parties are not responsible and shall not be liable for: (i) any telephone, electronic, hardware or software Promotion, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; (ii) failed, incomplete, garbled or delayed computer transmissions; (iii) late, lost, illegible, postage-due, incomplete, damaged or misdirected entries or mail; and (iv) any condition caused by events that may cause the Promotion to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel or suspend the Promotion or any portion thereof should any causes corrupt the administration, security or proper play of the Promotion; in which case, prizes will be awarded via a random drawing(s) from among the applicable eligible entries legitimately received prior to cancellation. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In no event will Released Parties be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of any entrant’s access to and use of any internet sites promoting or supporting the Promotion, or the downloading from and/or printing material downloaded from said sites. Without limiting the foregoing, everything on these sites is provided “as is” without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. When terms such as “may” are used in the Official Rules, Sponsor has sole and absolute discretion. By participating in this Promotion, entrants agree to waive any right to claim ambiguity or any deficiency in these Official Rules or the Promotion, including its administration. Prizes are non-transferable and no substitution or cash redemption will be permitted unless Sponsor, in its sole discretion, determines otherwise. Sponsor reserves the right to substitute a prize (or portion thereof) with one of equal or greater value, at its sole discretion. Any entrant may be disqualified in the Sponsor’s sole discretion: (1) if they fail to reply or to provide any required information or properly completed documents within the required time period (as applicable); (b) if they fail to comply with any of the terms of these Official Rules; or (c) if any prize notification is returned as undeliverable. In the event of disqualification, in Sponsor’s sole discretion, the prize may be awarded to an alternate winner selected from among the remaining applicable eligible entries via the means of winner determination described herein, pending verification of eligibility.
6. COLLECTION AND USE OF PERSONAL INFORMATION: As a condition of entering the Promotion, entrants agree and consent to Sponsor’s collection, use and retention of their personal and other information for all purposes related to the Promotion (including, without limitation, processing and administering entries or prize claims, sharing entrant’s personal information with third parties, including Sponsor’s service providers, contractors, prizing partners, etc. as necessary to conduct and operate the Promotion, communicating with and awarding prizes to winners, making public announcements about winners, and advertising, promotion and publicizing the Promotion), and to comply with applicable laws, rules and regulations, including the storing of your information for purposes of complying with state record retention requirements. Information collected from entrants will be subject to Sponsor’s Privacy Policy, published at https://drinktractor.com/privacy/ provided that in the event of any conflict between these Official Rules and such Privacy Policy, the terms of these Official Rules shall prevail. If you object to anything stated in these Official rules or Sponsor’s Privacy Policy, do not participate in the Promotion.
7. PUBLICITY: Participation in the Promotion shall constitute and signify the applicable entrant’s agreement and consent that Sponsor and its designees shall have a royalty-free, irrevocable, perpetual, non-exclusive, worldwide license, right, and permission to use entrant’s first and last names, Company name, address (city and state), photograph, likeness, voice, biographical information, participation information, written or oral statements related to Sponsor and/or the Promotion, and/or entrant’s prize information (collectively, the “Materials”), or to refrain from doing so, in any manner or media whatsoever, for advertising and promotional purposes in conjunction with the Promotion and similar promotions, without notice to or further approval of entrant, except where prohibited by law. Entrants acknowledge that they shall not have any right or claim of approval, including, but not limited to any right or claim of compensation, arising out of the use, alteration, distortion, or illusionary effect or use in any composite form of the Materials.
8. SEVERABILITY/HEADINGS: If any provision of these Official Rules is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Official Rules and shall not affect the validity and enforceability of any remaining provisions. Headings and captions are used in these Official Rules solely for convenience of reference, and shall not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof.
9. ARBITRATION/CHOICE OF LAW: Except where prohibited, by participating in the Promotion, entrants agree that (a) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or any prize awarded, or the determination of the winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, in Kootenai County, Idaho; (b) any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; (c) under no circumstances will an entrant will be permitted to obtain awards for (and entrant hereby waives all rights to claim) punitive, incidental and consequential damages and any other damages (other than for actual out-of-pocket expenses), and entrant further waives any and all rights to have damages multiplied or otherwise increased; and (d) an entrant’s remedies are limited to a claim for money damages (if any) and each entrant hereby irrevocably waives any right to seek injunctive or equitable relief. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Idaho, without regard for conflicts of law doctrine, and all proceedings shall take place in Kootenai County, Idaho.
10. WINNER LIST: For winners’ first name, last initial, city and state, mail a self-addressed, stamped envelope to be received by December 31, 2023 to: Tractor Drink Staff Incentive Promotion Winners, PMI Station, P.O. Box 750, Southbury, CT 06488-0750.
